Terms and Conditions of the Online Store
MikasaSport.EU
Specifying, among other things, the rules for concluding sales contracts via the Store, and containing essential information about the Seller, the Store, and Consumer rights.

Appendix No. 1: Model withdrawal form
§ 1 DEFINITIONS
Business days – days from Monday to Friday, excluding public holidays.
Account – a free functionality of the Store (an electronic service) governed by a separate regulation, enabling the Buyer to create an individual Account in the Store.
Consumer – a Consumer within the meaning of the provisions of the Polish Civil Code.
Buyer – any entity making a purchase in the Store.
Terms and Conditions – these Terms and Conditions.
Store – the online store MikasaSport.EU operated by the Seller at https://mikasasport.eu.
Seller – PIOTR LENART, conducting business under the name LENART PIOTR PETROPOLIS, entered into the Central Registration and Information on Business, NIP 6252053246, REGON 241672023, ul. Małobądzka 104, 42-500 Będzin.

§ 3 TECHNICAL REQUIREMENTS
For the proper functioning of the Store, the following are required:

A device with Internet access

A web browser supporting JavaScript and cookies
To place an order, an active e-mail account is additionally required.
§ 4 PURCHASES IN THE STORE

The prices of goods displayed in the Store are final prices, including VAT.

The Seller points out that the total order price includes the product price and, where applicable, shipping costs.

The selected product must be added to the cart.
-
The Buyer then selects a delivery method, a payment method, and provides the data necessary for order processing.

The order is placed once the Buyer confirms its contents and accepts the Terms and Conditions.
-
Placing an order constitutes the conclusion of a sales contract between the Buyer and the Seller.
-
The Seller will provide the Consumer with confirmation of the conclusion of the sales contract on a durable medium no later than upon delivery of the product.

The Buyer may create an Account or place orders without registration.
§ 5 PAYMENTS
Payment for an order may be made using the following methods:

Online payments – Shoper Payments (fast transfers processed by PayPro S.A. / Przelewy24)

The entity processing online payments is Autopay S.A.
If payment in advance is selected, the Buyer must complete payment within 7 business days from placing the order.
The Buyer accepts the use of electronic invoices. They may withdraw this consent.
§ 6 ORDER FULFILLMENT

The Seller must deliver goods free from defects.

The fulfillment time is indicated in the Store.

When prepayment is chosen, the Seller begins fulfilling the order after receiving payment.
-
For card or instant payments, order processing begins after successful authorization.
-
If an order includes products with different fulfillment times, the order will be processed according to the longest indicated time.

Poland, United Kingdom, Germany, Czech Republic, Slovakia, Lithuania, Latvia, Estonia, Spain, France, Italy, Hungary, Sweden, Portugal, Slovenia, Romania, Malta, Luxembourg, Ireland, Netherlands, Greece, Finland, Denmark, Cyprus, Croatia, Bulgaria, Belgium, Austria.

Personal collection at the company’s headquarters during opening hours
For personal collection, the product will be ready within the indicated fulfillment time.
§ 7 RIGHT OF WITHDRAWAL

A Consumer who concluded a distance or off-premises contract may withdraw from it within 14 days, subject to § 8.
-
The withdrawal period expires 14 days after:

The Consumer or a designated third party (other than the carrier) receives the goods
-
In the case of multiple items delivered separately — receipt of the last item
-

To exercise the right of withdrawal, the Consumer must inform the Seller using the contact details in § 2 by submitting an explicit statement.
-
The Consumer may use the model withdrawal form included in the Appendix but is not required to.
-
The deadline is met if the Consumer sends the statement before the withdrawal period expires.
Effects of withdrawal
-
The Seller refunds all payments, including standard delivery costs, no later than 14 days from receiving the withdrawal notice.
-
The Seller refunds using the same payment method used by the Consumer unless they agree otherwise.
-
The Seller may withhold the refund until receiving the goods or proof of their return.
-
Goods should be returned to ul. Małobądzka 104, 42-500 Będzin within 14 days.
-
The Consumer bears the direct cost of returning the goods.
-
The Consumer is liable for any diminished value of the goods resulting from use beyond what is necessary to establish their nature, characteristics, and functioning.
-
If return by standard mail is not possible due to the nature of the goods, the Consumer will bear the return cost — information is provided in the product description.

Refunds for card payments will be issued to the bank account assigned to the Consumer’s card.
§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to contracts:

For non-prefabricated items made to the Consumer’s specifications
-
For goods that deteriorate quickly or have a short expiry date
-
For sealed goods that cannot be returned for health or hygiene reasons once unsealed
-
For goods inseparably mixed with other items
-
For sealed audio, video, or software once unsealed
-
For newspapers, periodicals, or magazines (except subscriptions)
-
Whose price depends on market fluctuations beyond the Seller’s control
-
For digital content not supplied on a material medium if performance began with the Consumer’s prior consent
§ 9 COMPLAINTS

In the event of a defect, the Buyer may file a complaint based on statutory warranty (rękojmia) or under a product guarantee (if provided).

Under statutory warranty, the Buyer may within 24 months:

Request a price reduction
-
Withdraw from the contract in case of a significant defect
-
Request replacement with a defect-free item
-
Request repair
-

Complaints should be submitted to the postal or e-mail address provided in § 2.

If examination of the complaint requires returning the goods, the Buyer must deliver them, and the Consumer may do so at the Seller’s cost, to ul. Małobądzka 104, 42-500 Będzin.

If a guarantee applies, its terms are provided in the Store.
-
Complaints regarding Store operation may be submitted via e-mail.
-
Complaints are processed within 14 days.
Out-of-court dispute resolution
Consumers may use:

Permanent consumer arbitration courts

Assistance of municipal or district Consumer Ombudsmen

§ 10 PERSONAL DATA
The Seller is the administrator of the Buyer’s personal data.
Data is processed based on the contract and for its execution, in compliance with GDPR. Details are provided in the Store’s Privacy Policy.
§ 11 DISCLAIMERS

It is forbidden for the Buyer to provide unlawful content.

Each order constitutes a separate sales contract and requires separate acceptance of the Terms and Conditions.

Contracts under these Terms and Conditions are concluded in Polish.

Nothing in these Terms and Conditions limits Consumer rights under applicable law.
§ 12 PROVISIONS FOR BUYERS WHO ARE NOT CONSUMERS

The right of withdrawal does not apply to non-Consumer Buyers.
-
The Seller’s liability is limited to the value of the order.
-
Warranty liability toward non-Consumers is limited to one year.
-
Any disputes with non-Consumers will be resolved by the court competent for the Seller’s registered office.

§ 1 DEFINITIONS
Account – a free service regulated in this document that allows the Buyer to create an individual Store Account.
Buyer – any entity making a purchase in the Store.

§ 3 TECHNICAL REQUIREMENTS
To create and use an Account, you need:

An active e-mail account

A device with Internet access

A web browser supporting JavaScript and cookies
§ 4 ACCOUNT
Creating an Account is voluntary.
An Account provides additional features such as order history, order status tracking, and editing Buyer data.
To create an Account, the registration form must be completed.
Upon creating an Account, an indefinite-term agreement is concluded for maintaining the Account.
The Buyer may delete the Account at any time without cost.
To delete the Account, an e-mail request should be sent to biuro@petropolis.com.pl. The Account will then be removed without delay.
§ 5 COMPLAINTS
Complaints regarding the Account should be sent to biuro@petropolis.com.pl.
The Seller will respond within 14 days.
OUT-OF-COURT DISPUTE RESOLUTION
Consumers may use:

§ 6 PERSONAL DATA
The Seller is the controller of personal data.
Data is processed based on the contract and according to GDPR.
Details are in the Privacy Policy.
§ 7 RESERVATIONS
Providing illegal content is prohibited.
Account agreements are concluded in Polish.
The Seller may amend these Terms for important reasons (legal changes, security, service modifications).
The Buyer will be informed at least 7 days before changes take effect.
If the Buyer does not accept the changes, he must notify the Seller, which will result in Account termination.
Lack of objection means acceptance.
Disputes with non-consumers are resolved by the court competent for the Seller’s seat.
Consumer rights cannot be excluded or limited.
Newsletter Terms and Conditions

§ 1 DEFINITIONS
Newsletter – a free service allowing the User to receive Store-related e-mails including offers, promotions, and news.
Store – SportowaKraina.PL at https://sportowakraina.pl
Service Provider – PETROPOLIS PIOTR LENART, ul. Małobądzka 104, 42-500 Będzin.
User – any entity using the Newsletter service.
§ 2 NEWSLETTER
Use of the Newsletter is voluntary.
Required: Internet-enabled device, updated browser with JavaScript and cookies support, active e-mail account.
Messages will be sent to the e-mail provided during sign-up.
To subscribe, the User enters an e-mail address and confirms it via a verification message.
Each message includes an unsubscribe link.
The User may unsubscribe at any time free of charge via the link or by sending an e-mail to biuro@petropolis.com.pl.
Unsubscribing terminates the service immediately.
§ 3 COMPLAINTS
Complaints regarding the Newsletter should be sent to biuro@petropolis.com.pl.
The Service Provider will respond within 14 days.
§ 4 PERSONAL DATA
The Service Provider is the administrator of personal data.
Data is processed based on the contract according to GDPR.
Details are in the Store’s Privacy Policy.
§ 5 FINAL PROVISIONS
The Service Provider may amend these Terms for important reasons (modernization or legal changes).
Users will be notified by e-mail at least 7 days in advance.
Lack of objection means acceptance.
If the User does not accept the changes, they must inform the Service Provider, resulting in service termination.
Providing illegal content is prohibited.
